Welcome to Michelle Maxwell Mobile Notary & Signing Services. By scheduling or using our services, you acknowledge and agree to the following terms and conditions.
1. Notarial Services
Michelle Maxwell Mobile Notary & Signing Services provides notarial services in accordance with applicable Texas laws and regulations.
A notary public is an impartial witness and does not provide legal advice.
Michelle Maxwell Mobile Notary & Signing Services does not provide legal advice, legal representation, or legal document preparation.
Texas law prohibits a notary who is not an attorney from practicing law, preparing, drafting, selecting, or advising concerning legal documents.
2. Customer Responsibility
Customers are responsible for:
- Providing the documents requiring notarization
- Reviewing their documents before the appointment
- Providing appropriate identification
- Knowing what type of notarization or notarial act is required
- Providing any witnesses required for the document
- Ensuring all required signers are present
- Providing accurate appointment information
A notary cannot determine the legal effect of your document or provide legal advice regarding which document or notarial certificate you should use.
Texas guidance states that a non-attorney notary may not select the notarial certificate for a customer or provide legal advice concerning legal documents.
3. Identification
Customers must provide acceptable identification when required by applicable law.
The notary may refuse to perform a notarization when legally required to do so.
4. Personal Appearance
The signer must personally appear before the notary when required by applicable law.
Texas specifically prohibits performing notarization when the signer did not personally appear before the notary.
5. Appointment Scheduling
Appointments are scheduled based on availability.
Customers are responsible for providing accurate contact information and appointment details.
An appointment is not considered confirmed until confirmation is provided through the booking system or otherwise confirmed by the business.
6. Mobile Notary Appointments
For mobile appointments, customers are responsible for providing an accurate and safe appointment location.
Additional travel or convenience fees, if applicable, will be communicated before the appointment.
7. Cancellations and Rescheduling
Customers should provide reasonable advance notice when cancelling or rescheduling an appointment.
Appointments cancelled or rescheduled at least 48 hours before the scheduled appointment may be rescheduled without a cancellation fee. Appointments cancelled with less than 48 hours’ notice or missed appointments may be subject to applicable fees.
8. Fees and Payment
Notary fees will be communicated to the customer before or at the time of service, as applicable.
Texas law establishes maximum fees that a Texas notary may charge for official notarial acts. A notary may charge less than the statutory maximum, but excessive fees can result in disciplinary consequences.
Any separate mobile, travel, convenience, administrative, or other service charges should be clearly disclosed and structured in accordance with applicable law.
9. Refusal or Inability to Perform a Notarization
A notary may decline or be unable to complete a notarization when required by law or when applicable requirements have not been met.
Examples may include:
- Insufficient identification
- Required signer not present
- Signer appears unwilling or unable to understand the transaction
- Document or circumstances do not satisfy applicable requirements
- Other circumstances requiring refusal under applicable law
10. No Legal Advice
Michelle Maxwell Mobile Notary & Signing Services is not a law firm and does not provide legal advice.
We do not:
- Draft legal documents
- Select legal documents for customers
- Interpret legal documents
- Advise customers about legal rights or obligations
- Recommend which type of notarization a customer should obtain
Customers who need legal advice should consult a licensed attorney.
11. Limitation of Responsibility
Customers are responsible for the accuracy and completeness of their documents and for determining whether notarization is appropriate for their transaction.
The notary does not guarantee that a notarized document will be accepted by a particular court, government agency, lender, title company, financial institution, or other organization.
12. Changes to These Terms
We may update these Terms & Conditions from time to time. Updated terms will be posted on this page with a revised effective date.
